General terms of use.

These Terms of Use (the "Terms") set out how any user (the "User") may access and use the Winaity website and services.

They apply to the winaity.com website and to the Winaity Connect application (connect.winaity.com). Subscriptions to paid services are governed by the Terms of Sale.

By accessing the website or using the services, the User acknowledges having read these Terms and accepts them without reservation.

The website is available free of charge to any User with Internet access. The costs of this access (equipment, connection) are borne by the User.

Winaity takes reasonable measures to provide continuous access to the service, without this constituting an obligation of result. Access may be interrupted, in particular for maintenance.

Some features require an account. The User undertakes to provide accurate information and to keep it up to date.

The User alone is responsible for keeping their login details confidential and for any activity carried out from their account. They must inform Winaity without delay of any unauthorised use.

The User undertakes to use the service fairly and for its intended purpose. In particular, they must not:

• Harm the operation, security or integrity of the service
• Distribute unlawful or defamatory content, or content that infringes the rights of third parties
• Use the service for prospecting that does not comply with the regulations in force
• Attempt to gain unauthorised access to Winaity's systems or data
• Reproduce, extract or reuse all or part of the service without permission
• Collect other users' personal data without their consent
• Access the website or the service with robots or other automated tools without Winaity's prior written permission, other than the Winaity Connect public API used with its key

The website, the services and all their components are protected by intellectual property law and remain the exclusive property of Winaity. Nothing in these Terms may be interpreted as a transfer of rights to the User.

Winaity may change, suspend or interrupt all or part of the service for maintenance, improvement or security reasons, while striving to limit the inconvenience to the User.

Winaity cannot be held liable for damage resulting from misuse of the service by the User, from temporary unavailability, or from events beyond its reasonable control.

The User alone is responsible for the content they publish or transmit through the service and indemnifies Winaity against any claim in this respect.

If the User breaches these Terms, Winaity reserves the right to suspend or terminate their access to the service, without notice in the event of a serious breach, and without prejudice to any damages.

Winaity may change these Terms at any time. The applicable Terms are those in force on the date the service is used. It is the User's responsibility to read them regularly.

These Terms are governed by French law. Any dispute concerning their interpretation or performance falls within the jurisdiction of the competent courts of Paris, failing an amicable settlement.
